This Privacy Policy applies to all of the products, services, and Websites offered by Kangoogo, and details important information regarding the use and disclosure of User information collected on the Website.

TERMS OF SALE
1. Object
1.1. These are the conditions governing access, purchase, and shipment of the products offered in the online store kangoogo.com (the "Shop").
1.2. The Shop belongs to Kangoogo (hereafter "Kangoogo").
1.3. Access to, purchase of products from, or use of the Shop by the user implies full and unreserved acceptance of each and every one of the present General Conditions.
1.4. Every order placed on the Shop is governed by the General Conditions applicable at the order date.
2. Products
2.1. Although the product photographs shown in the Shop provide an accurate detail of the product, the real product may vary slightly in colors and shape.
2.2. Product offerings are valid as long as stocks are available. Upon receipt of the order validated by the Purchaser, Kangoogo will verify the availability of the products ordered.
2.3. In case of temporary unavailability, Kangoogo reserves the right to offer substitute products of equal or greater quality and value. If you do not wish to order such substitute products, we will reimburse any amount paid and cancel the order.
2.4. If an order is cancelled, a cancellation email will be sent to the Buyer. In case of payment by PayPal, the refund will be issued within thirty (30) days.
2.5. The temporary unavailability or final exhaustion of the stock of a product under an order will not affect the processing and delivery of the remainder of the order.
3. Orders
3.1. The information contained in these General Terms does not constitute an offer to sell, but an invitation to contract. No contract will exist between you and Kangoogo until your order has been accepted by us.
3.2. Only the products listed in the shipping confirmation will be subject to the contract.
3.3. To place an order, the Buyer may: 1) register in the online store; or 2) purchase as a guest by filling in the required personal information and accepting these General Terms.
3.4. The order will be processed in five steps: user identification, billing and shipping information, type of delivery and payment, order confirmation, and shipment.
3.5. Once authorized, the Buyer will receive an email acknowledging receipt of the order. This email does not mean that the order has been accepted. The purchase contract is only formed upon receipt of a shipping confirmation email.
4. Price and Payment
4.1. PayPal: Buyers wishing to pay through PayPal must enter their PayPal-linked email address and password at the time of order validation.
4.2. The price of each product will be as stipulated in the online shop at the time of the order, except in cases of obvious error. If a pricing error is identified, we will inform you and offer the option to reconfirm your order at the correct price or cancel it.
4.3. Kangoogo retains ownership of products until full payment is received.
4.4. Kangoogo is not obliged to supply any product at an incorrect price even after having sent the Order Confirmation if the pricing error is obvious and unmistakable.
4.5. Prices on this website include HST, but exclude shipping costs, which will be added to the total amount due.
4.6. Prices may change at any time, but changes will not affect orders for which an Order Confirmation has already been sent.
4.7. Any additional customs fees or taxes that must be paid are borne by the Buyer.
5. Delivery
5.1. Delivery Address: When placing an order, the Buyer must provide the delivery address. Orders will be delivered to the address indicated at checkout. If the Buyer is absent at the time of delivery, a delivery notice may be left. We are not responsible for delivery errors resulting from incorrect or incomplete information provided by the Buyer.
5.2. Shipping Costs: Shipping and handling fees will be charged for each order, based on the delivery destination, quantity of goods ordered, and selected shipping method. These costs are clearly indicated before order confirmation.
5.3. Shipping Carriers and Services: For free delivery, we select the carrier and service offering the best price and delivery times based on the destination. Carriers may vary.
5.4. Delivery Timeframes:

Quebec and Ontario: Estimated delivery between 1 and 10 business days.

Western Canada and Remote Regions: Delivery may take up to 3 weeks.
These timeframes are estimates and may be affected by factors beyond our control (weather conditions, customs delays, carrier disruptions, force majeure, etc.). Unless otherwise specified in the Order Confirmation, delivery will occur within the timeframe indicated therein, or within 15 days from the Order Confirmation date.
5.5. Delay and Right to Cancel: If we are unable to meet the indicated delivery timeframe, we will notify the Buyer and offer the option to accept a new delivery date or cancel the order with a full refund. In accordance with Canadian and Quebec consumer protection laws, if the order is not delivered within the agreed timeframe or within 30 days where no specific date was agreed, the Buyer may cancel the contract and obtain a full refund.
5.6. Failed Delivery Attempts: After two failed delivery attempts, the Buyer may be required to collect the order at the carrier's designated pickup location. The Buyer has 30 days from the shipment confirmation date to collect the order. If not collected within this period, the contract will be considered cancelled.
5.7. Free Shipping: Free shipping is offered for orders shipped within Canada. Certain remote regions may not qualify. In such cases, we will contact the Buyer to pay additional shipping fees or cancel the order with a full refund.
6. Responsibility
6.1. Kangoogo is not responsible for delivery delays caused by force majeure events or total or partial strikes of transport services.
6.2. Kangoogo is not responsible for delivery delays caused by the carrier.
6.3. The responsibility of Kangoogo in connection with any product purchased on our website is strictly limited to the purchase price of the product.
6.4. Kangoogo is not responsible for any inconvenience or damage relating to the use of the Internet that is totally unrelated to Kangoogo.
7. Warranty, Refunds, and Returns
7.1. Final Sale — All sales are considered final. No exchange or refund is possible, except as expressly provided in articles 7.2 and 7.3 below.
7.2. Limited 4-Day Manufacturing Defect Warranty — Kangoogo offers a limited 4-day warranty from the date of receipt of the product, covering exclusively visible manufacturing defects. This warranty does not cover damage caused by normal use, accidents, misuse, negligence, unauthorized modifications, or any other external cause.
Warranty Claim Procedure:

Timeline: You must notify us of the defect within 4 days of receiving the product.

Notification: Send an email to contact us describing the problem and attaching clear photos of the defect.

Product Return: The product must be returned in its original packaging, with tags and proof of purchase. No used, Buyer-damaged, or unpackaged product will be accepted.

Costs: All return and re-shipping costs are borne by Kangoogo.

Resolution: We will proceed with repair or replacement of the defective product.
7.3. Defective, Misprinted & Damaged Items
We stand behind the quality of our work. If you receive products that are misprinted, defective, or damaged during manufacturing or shipping, we will make it right.
Claim Window:
Any claims for misprinted, defective, or damaged items must be submitted within 4 business days of receiving your order. Claims submitted after this period may not be eligible for resolution.

What to Include:
When submitting a claim, please provide your order number, a detailed description of the issue, and clear photographs showing the defect or damage. Claims without supporting photographs may be delayed or denied.
Resolution:
Claims deemed to be an error on our part will be resolved at our expense. Depending on the nature of the issue, we may offer a replacement or refund at our discretion. Original items may need to be returned to us (at our expense).
In Plain Terms:
If we made a mistake, we’ll fix it. Report any issues within 4 business days with photos and your order number, and we’ll replace or refund.
7.4. Quality Control — Kangoogo performs a double quality control check on each product prior to shipment to minimize the risk of defects. Despite these precautions, if you receive a product with a visible manufacturing defect, please contact us immediately at contact us.
7.5. Incorrect Product Received: If you did not receive the right item, please notify us immediately at contact us. You may return the product and request an exchange. We will send you the correct product with special attention. All shipping costs are borne by Kangoogo.
7.6. Consumer Rights (Quebec Consumer Protection Act and Canadian Federal Law) — In accordance with the Quebec Consumer Protection Act (R.S.Q., c. P-40.1) and applicable federal Canadian laws, nothing in these conditions is intended to limit or exclude consumers' non-waivable legal rights. In particular, the legal warranties against latent defects and hidden defects provided by law apply regardless of this warranty policy.
8. Intellectual Property
8.1. Kangoogo owns the intellectual and industrial property rights of the Website and all online store content. Allowing users to access the Website does not constitute a waiver, license, or transfer of these rights.
8.2. It is forbidden to modify, copy, reuse, exploit, reproduce, publicly communicate, upload, post, transmit, use, process, or distribute in any way all or part of the contents of this Website for public or commercial purposes without authorization from Kangoogo.
9. Written Communications
9.1. By using this Website, the Buyer agrees that most communications with Kangoogo will be electronic. We will contract with you via email or by posting notices on this Website. You agree to this electronic means of communication.
10. User-Submitted Materials
10.1. The User is solely responsible for content (images, videos, texts) submitted or uploaded to the Website. The User guarantees that they hold the necessary rights and permissions to authorize Kangoogo to publish and distribute such content.
10.2. The User guarantees that they have obtained the written consent of each identifiable person appearing in the submitted content.
10.3. The User guarantees that submitted content is not illegal, defamatory, pornographic, racist, or infringing on intellectual property or the dignity of any person.
10.4. By submitting content, the User grants Kangoogo a worldwide, royalty-free, non-exclusive, sub-licensable license to use, reproduce, distribute, and publicly communicate that content.
